4. Shipping and Risk of Loss
A. Transfer of Risk
Unless otherwise explicitly stated in writing, all purchases are made pursuant to a shipping contract. The terms of delivery are FOB (Free On Board) Shipping Point. This means that the risk of loss, damage, or destruction of the purchased product passes from “bubbles n bath” to you, the customer, at the moment the product is delivered to the common carrier (e.g., USPS, FedEx, UPS) for shipment.

B. Customer Responsibility
If a package is lost, stolen, or damaged after the carrier accepts it for shipment (including “porch theft” or damage during transit), the customer bears the risk and must file any claim directly with the shipping carrier. “bubbles n bath” is not responsible for refunding or replacing products lost after they are handed to the carrier.

5. Order Cancellation, Returns, Refunds, and Replacements
The following policy regarding cancellations, refunds, returns, and replacements is displayed prominently on our website at checkout and is incorporated into these Terms by reference.

A. Order Cancellation and Refunds
A full refund will be issued if the order is cancelled by the Customer before the order has been legally accepted by us (i.e., before the products have been physically shipped and the contract of sale is formed).

No cancellation or refund is possible once the order has been accepted or shipped.

If an order is cancelled by “bubbles n bath” due to unforeseen reasons (such as inability to fulfill the order), you will receive a full refund.

B. Returns and Exchanges Policy
Due to the hygienic nature of our bath and body products, returns of opened merchandise for simple change of mind or subjective dissatisfaction are not accepted. Our commitment is limited to providing replacements or exchanges for products that are demonstrably defective or incorrect upon receipt.

C. Replacements for Damaged or Incorrect Products
While we take every measure to ensure safe delivery, “bubbles n bath” will be happy to offer a replacement or exchange of equal value if you happen to receive a:

Damaged or broken product, or

Incorrect product (different from what you ordered).

D. Mandatory Requirements for Claiming a Replacement
To ensure a smooth and verifiable resolution, we require the following:

Unboxing Video (Mandatory): A continuous video recording starting with the sealed package exactly as received. The shipping label and outer packaging must be clearly visible in this initial footage. Requests without a proper unboxing video will not be processed.

Clear Photographic Evidence: High-quality images clearly highlighting the damage or the incorrect item.

Timely Reporting: The issue must be reported to “bubbles n bath” within 24 hours of receiving your parcel.

E. How to Report an Issue

Your order number.

The unboxing video (as per the above guidelines). Once received, our team will verify the details and, if eligible, arrange for a replacement or exchange at the earliest.

F. Exceptions
Sale items, discounted products, and customized orders are not eligible for replacement unless they are damaged in transit.

6. Intellectual Property and User-Generated Content
A. Ownership

The arbitration shall be administered by Monika Patil in accordance with its Consumer Arbitration Rules. The seat of the arbitration shall be in Monika Patil.

You and “bubbles n bath” agree that each party may bring claims against the other only in its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. By agreeing to these terms, you knowingly and voluntarily waive any right to a trial by jury or to participate in a class action lawsuit or class-wide arbitration.

D. Pre-Arbitration Requirement
Before commencing arbitration, you agree to contact us at store@bubblesnbaths.com to attempt to resolve the dispute informally through good-faith negotiation.

8. DISCLAIMER OF WARRANTIES
THIS SECTION IS A LEGAL DISCLAIMER OF ALL WARRANTIES. AS REQUIRED BY THE UNIFORM COMMERCIAL CODE (UCC) AND STATE LAW, THIS DISCLAIMER IS MADE IN ALL CAPITAL LETTERS AND BOLD TYPE TO ENSURE IT IS CONSPICUOUS.

EXCLUSION OF WARRANTIES ALL GOODS ARE PURCHASED BY THE PURCHASER “AS IS” AND “WITH ALL FAULTS”. “BUBBLES N BATH” MAKES NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY, OR ANY OTHER MATTER WITH RESPECT TO THE GOODS SOLD.

B. EXPRESS WARRANTY LIMITATION NO AFFIRMATION OF FACT, PROMISE, OR REPRESENTATION MADE BY THE SELLER, ITS EMPLOYEES, OR REPRESENTATIVES—UNLESS CONTAINED IN A SEPARATE, SIGNED WRITTEN AGREEMENT—SHALL BE DEEMED TO CREATE AN EXPRESS WARRANTY THAT THE GOODS WILL CONFORM TO SUCH AFFIRMATION OR PROMISE.

9. LIMITATION OF LIABILITY AND INDEMNIFICATION
A. Limitation of Liability (L.O.L.)
To the fullest extent permitted by law, Bubbles n Bath shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages (including, but not limited to, damages for lost profits, loss of data, or business interruption). In all circumstances, your sole and exclusive remedy for any claim against “bubbles n bath” is limited to the amount you paid for the product(s) that are the subject of the claim.

B. Indemnification
You agree to indemnify, defend, and hold harmless Bubbles n Bath from and against any and all third-party claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or in any way connected with (1) your breach of these Terms, (2) your negligence or willful misconduct, or (3) your misuse of the products.

10. General Provisions
A. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Maharashtra (excluding its conflict of law principles). The exclusive venue for any judicial proceeding that arises despite the Arbitration clause (e.g., small claims court) shall be the courts located in Navi Mumbai.

B. Force Majeure
“bubbles n bath” shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, without limitation, acts of God, war, terrorism, natural disasters, labor disputes, regulatory changes that impact production, or failure of critical supply chain elements. Performance under these Terms is suspended for the period of the Force Majeure event.

C. Severability
If any part, term, or provision of these Terms is held by a court of competent jurisdiction to be illegal, invalid, or otherwise unenforceable, the remaining portions shall be considered fully severable and shall continue in full force and effect. The invalid provision will be automatically modified to the minimum extent necessary to comply with applicable law.

D. Modifications
We reserve the right to update or change these Terms at any time. We will post the revised Terms on this page. Your continued use of the website or purchase of products following the posting of any changes constitutes acceptance of those changes.
